Please read this Privacy Policy carefully as it describes GOSU MEDIA PTE. LTD.’s (“we”, “us” or “our”) collection, use, disclosure, retention and protection of personal data in our possession or under our control, including personal data in the possession of organisations which we have engaged to collect, use, disclose or process personal data for our purposes, in accordance with the Personal Data Protection Act 2012 of Singapore (“PDPA”). Unless otherwise defined, terms used in this Privacy Policy shall have the meanings given to them in the PDPA, where the context so permits.

This Privacy Policy applies to every user who visits https://www.gosugamers.net (the “Site”), all products and services offered under our group, including the “GosuGamers” brand, and any other website(s) or service(s) which references this Privacy Policy. Third parties you interact with through us may have different privacy policies and you should review their privacy policies carefully before sharing your information with them. By accessing the Site, our other website(s) and/or using our products and services, you agree and provide us, our authorised service providers and third parties with your consent to collect, use, disclose and/or retain your personal data in the manner set forth in this Privacy Policy. 

This Privacy Policy supplements but does not supersede nor replace any other consent which you may have previously provided to us, nor does it affect any right that we may have at law in connection with the collection, use, disclosure and/or retention of your personal data. 

This Privacy Policy forms part of the terms and conditions governing your relationship with us and should be read in conjunction with the GosuGamers Terms of Service (“Terms of Service”) accessible at https://www.gosugamers.net/terms. In the event of any inconsistency between the provisions of the Privacy Policy and the Terms of Service, the provisions of the Terms of Service shall prevail.   

We recognise the importance of maintaining the privacy of every user who visits the Site, our other website(s) and uses our products and services. We value your privacy and appreciate your trust in us. We are committed to being transparent about the personal data we collect from you, how it is used, and with whom it is shared.

1. How we collect information

To the extent permissible under applicable law, we collect information about you and any other party whose details you provide to us when you interact with us. Generally, we collect information:

1. when you complete online forms, take part in promotions, initiatives, surveys, enter any competitions or prize draws, download information such as white papers or other publications or participate in any other interactive areas that appear on the Site or any other website(s) with our services;
2. when you interact with us using social media;
3. when you provide your contact details to us when accessing any websites or services we make available or when you update those details; and contact us offline, for example by telephone, email or post;
4. when you register for membership or contest participation, which may require you to supply certain personal information including, but not limited to your name, age, sex, contact number, email address and demographic information (such as your area, location, Information Protocol (“IP”) and address etc.);
5. through the technology you use to access the Site, our other website(s) and/or our services, including mobile devices and browsers (for example, we may collect the device identification number and type, location information and connection information such as statistics on your page views, traffic to and from the sites, referral URL, ad data, and your IP address using Cookies or similar technologies); and
6. when you respond to our request for additional personal data.

We may enhance personal information we collect from you with information we obtain from third parties that are entitled to share that information; for example, information from data management platforms, but in each case as permitted by applicable laws.

If you intend on giving us personal information about someone else, you are responsible for ensuring that you comply with any obligation and consent obligations under applicable data protections laws. In so far as required by applicable data protection laws, you must ensure that you have their explicit consent to do so beforehand and that you explain to them how we collect, use, disclose and retain their personal information or direct them to read our Privacy Policy.

We take all reasonable measures to ensure that your personal data remains accurate, complete and up-to-date. You may request access to or make corrections to your personal data records but we reserve the right to charge a reasonable fee for processing your request. 2. How we use the information

To the extent permissible under applicable law, we use and/or disclose your information:

• to provide any information, perform obligations, in the course of or in connection with our provision of services that you have requested;
• to compare information for accuracy and to verify it with third parties;
• to provide, maintain, protect and improve any products, services and information that you have requested from us;
• to personalize your experience (your information helps us to better respond to your individual needs);
• to improve our website (we continually strive to improve our website offerings based on the information and feedback we receive from you);
• to improve customer service (your information helps us to more effectively respond to your customer service requests and support needs);
• to administer a contest, promotion, survey or other website features;
• to send periodic emails (e.g. with company news, updates, related product or service information, etc.)​;
• to manage and administer your use of products and services you have asked us to provide;
• to manage our relationship with you (for example, customer services and support activities);

• to detect, prevent, investigate or remediate, crime, illegal or prohibited activities or to otherwise protect our legal rights (including liaison with regulators and law enforcement agencies for these purposes);
• to contact you to see if you would like to take part in our customer research (for example, feedback on your use of our products and services);
• to monitor, carry out statistical analysis and benchmarking, provided that in such circumstances it is on an aggregated basis which will not be linked back to you or any living individual;
• to deliver targeted advertising, marketing or information to you;
• to deliver joint content and services with third parties with whom you have a separate relationship (for example, social media providers); 
• to provide you with location-based services (for example, advertising and other personalised content), where we collect geo-location data;
• to check specific information from your device or systems directly relevant to your use of the websites, or services against our records to make sure the websites, or services are being used in accordance with our end-user agreements and to troubleshoot any problems;
• to obtain information relating to any technical errors or other issues with our website and services;
• to collect information about how you and users use the functions of the features of our website and services; 
• to gather statistical information about the operating system and environment from which you access our applications or services;
• to enable you to manage your privacy settings within your browser or our website and services (where applicable);
• to gather and deliver targeted advertising, marketing or information to you which may be useful, based on your use of the website or services or any other information we have about you (depending on the websites or services, you may able to configure these features to suit your preferences).
• in relation to information which we collect during communications with you which may be monitored and recorded, for training purposes, quality assurance, to record details about our website and services you order from us or ask us about, and in order to meet our legal and regulatory obligations generally;
• to verify your identity; 
• to process payment or credit transactions;
• to comply with any applicable laws, regulations, codes of practice, guidelines, rules or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority; and
• for any other incidental business purposes and for any other purposes for which you have provided the information.

3. Sharing your information

We may disclose and share your information with:

• customer relationship management software to provide you with any information, products or services that you have requested;
• unaffiliated third parties, including but not limited to our third-party service providers, vendors, contractors, agents and other organisations (including their respective sub-contractors), whether in Singapore or abroad for the purposes in Section 2 above. For example, we may share your information with internet service and platform providers, advertising agencies, agency trading desks, supply side platforms, website and mobile app publishers, resellers, developers and data management platforms so that they may help us to provide you with the products, services and information you have requested or which we believe is of interest to you;
• third parties, such as social media sites or third party application providers, who you have a relationship with and you have consented to us providing them with your personal data;
• third parties for marketing purposes, including but not limited to our business partners and other third parties with whom we work with and whose products or services we think will interest you. By accessing our Site and other website(s) and/or using our services, you have provided us with your consent for such use. To opt-out of such disclosure, please see the instructions for withdrawing your consent within this Privacy Policy below or refer to the relevant business partner’s privacy policy;
• external banks, financial institutions, credit card companies, credit reference and fraud prevention agencies and their respective service providers;
• any governmental, judicial and/or regulatory authority in compliance with applicable laws, regulations, codes of practice, guidelines, rules or to assist in law enforcement and investigations conducted;
• our own professional advisors, including but not limited to legal advisors and auditors, for the purpose of seeking professional advice or to meet our audit responsibilities or statutory obligations;
• third parties who wishes to acquire any part of our business or assets;
• third parties to whom we have transferred our rights and obligations in relation to the agreement we have with you; 
• to any other person related to or in connection with Section 2 above; and
• to use and share your personal data with our affiliates globally for the purposes set out above, including but not limited to sending you marketing and promotional materials on goods and/or services offered by our affiliates. In such instances, your information may be transferred, stored or processed in countries outside of where you live for the purposes described in this Privacy Policy; 

4. Marketing

From time to time, we may use your information to contact you with details about our products and services which we feel may be of interest to you. We may also share your information with other companies and carefully selected third parties so that they (or we) may contact you with information about their products or services which we feel may be of interest to you. 

You have the right at any time to opt out from receiving marketing materials from us or request at any time that we do not share your information with third parties for marketing purposes as referred to in this paragraph. If you wish to exercise these rights, you can do so by sending us an email to [email protected] or choose to unsubscribe from any of our marketing emails using the links included in such emails.

5. Your information and your rights

If you are based within the EEA or within another jurisdiction having similar data protection laws, in certain circumstances you have the following rights:

• the right to be told how we use your information and obtain access to your information;
• the right to have your information rectified or erased or place restrictions on processing your information;
• the right to object to the processing of your information e.g. for direct marketing purposes;
• the right to have any information you provided to us on an automated basis returned to you in a structured, commonly used and machine-readable format, or sent directly to another company, where technically feasible (“data portability”);
• where the processing of your information is based on your consent, the right to withdraw that consent subject to legal or contractual restrictions;
• the right to object to any decisions based on the automated processing of your personal data, including profiling; and
• the right to lodge a complaint with the supervisory authority responsible for data protection matters (e.g. in the UK, the information Commissioner’s Office).

Personal information in the European Union is protected by data protection laws but other countries do not necessarily protect your personal information in the same way.

Our website and some of our applications or services or parts of them may also be hosted in the United States or otherwise outside of the EEA (which means all the EU countries plus Norway, Iceland and Liechtenstein) (“EEA”) and this means that we may transfer any information which is submitted by you through the website or the application or service outside the EEA to the United States or to other territories outside of the EEA. When you send an email to us, this will also be stored on email servers which are hosted with Google and therefore may be outside of the EEA.

We may use service providers based outside of the EEA to help us provide our website and services to you and this means that we may transfer your information to service providers outside the EEA for the purpose of providing our advertising and services to you.

We take steps to ensure that where your information is transferred outside of the EEA by our service providers and hosting providers, appropriate measures and controls are in place to protect that information in accordance with applicable data protection laws and regulations. In each case, such transfers are made in accordance with the requirements of Regulations (EU) 2016/679 (the General Data Protection Regulations or “GDPR”) and may be based on the use of the European Commission’s Standard Model Clauses for transfers of personal data outside the EEA.

By using our website, products or services or by interacting with us in the ways described in this Privacy Policy, you consent to the transfer of your information outside the EEA in the circumstances set out in this Privacy Policy. If you do not want your information to be transferred outside the EEA you should not use our website, applications or services.

6. How Long We Keep Your Personal Data

We will retain your personal information for the duration of our business relationship and afterwards for as long as is necessary and relevant for our legitimate business purpose, legal purpose or to fulfil the purpose for which it was collected, in accordance with applicable laws and regulations. Where we no longer need your personal information, we will dispose of it in a secure manner (without further notice to you).  

If we have asked for your permission to process your personal data and we have no other lawful grounds to continue with processing the same, and you withdraw your permission, we shall dispose of your personal data in a secure manner.

7. Personal Data of those below 16 years old

As our website, products and services are all directed to people who are at least 16 years old or older, we do not collect any information from anyone under 16 years of age. 

8. Security and storage of information

We will keep your information secure by taking appropriate technical and organisational measures against its unauthorised or unlawful access, collection, use, disclosure, copying, modification, disposal processing or similar risks, in accordance with applicable laws. 

While we will do our best to protect your personal information, we cannot guarantee the security of your information which is transmitted to our website or services or to other websites, applications and services via the internet or similar connection. If we have given you (or you have chosen) a password to access certain areas of our websites or services, please keep this password safe – we will not share this password with anyone. 9. Other sites and social media

If you follow a link from our website or service to another site or service, this notice will no longer apply. We are not responsible for the information handling practices of third-party sites or services and we encourage you to read the privacy policies appearing on those sites or services.

Our websites or services may enable you to share information with social media sites, use social media sites to create your account or to connect your social media account. Those social media sites may automatically provide us with access to certain personal information retained by them about you (for example any content you have viewed). You should be able to manage your privacy settings from within your own third-party social media account(s) to manage what personal information you enable us to access from that account.

10. Google Analytics

GosuGamers utilises Google Analytics, which is a web analytics service offered by Google LLC (“Google”) that tracks and reports website traffic parameters. Google uses the data collected to track and monitor the use of websites. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the advertisements of its own advertising network. You can opt-out of having made your activity on the websites available to Google Analytics by installing the Google Analytics ‘opt-out’ Internet browser add-on. 

11. Cookies, analytics and traffic data

Cookies are small text files which are transferred from our websites or services and stored on your device. We use cookies to help us provide you with a personalised service, and to help make our websites and services better for you.

Our cookies may be session cookies (temporary cookies that identify and track users within our websites or services which are deleted when you close your browser or leave your session in the service) or persistent cookies (cookies which enable our websites or services to “remember” who you are and to remember your preferences within our websites or services and which will stay on your computer or device after you close your browser or leave your session in the application or service).

You may be able to configure your browser, our website or the websites of our partners to restrict cookies or block all cookies, if you wish. However, if you disable cookies you may find this affects your ability to use certain parts of our website or services. 

12. Third Party Services

Certain services or advertisement made available on our websites are delivered or managed by third parties. In addition, if you follow a link from our website(s) to another website or service platform, this Privacy Policy shall no longer apply. We are not responsible for the privacy practices of such other sites operated by third parties, even though it is linked to our website(s). You should refer to the privacy policies of such third-party website(s) and contact its owner or operator if you have any concerns or questions. 

By accessing and browsing the functions on our website(s), you shall also be consenting to and be subject to the terms of YouTube’s Terms of Service, YouTube’s API Services and Google’s Privacy Policy. 

Our websites or services may enable you to share information with social media sites or use social media sites to create your account or link to your social media account. Those social media sites may automatically provide us with access to certain personal information retained by them about you (for example any content you have viewed). If you would like to manage what personal information you enable us to access from that account, you can review the privacy settings of your own social media account(s).

13. Withdrawal of Consent

If you wish to withdraw your consent to any use or disclosure of your personal data as set out in this Privacy Policy, you may contact us via [email protected]. Please note that if you withdraw your consent to any or all use or disclosure of your personal data, depending on the nature of your request, we may no longer be in a position to provide all or part of our services to you, and you may no longer be able to access all or part of our website(s). Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclosure without consent is permitted or required by applicable laws.  

14. Changes to our Privacy Policy

We may update our Privacy Policy from time to time. Any updates to this Privacy Policy will be published on the Site. You may determine if any such revision has taken place by referring to the date on which this Privacy Policy was last updated. Your continued use of our service and/or website(s) constitute your acknowledgement and acceptance of such change.
