Blizzard Sued by MDY (WoWGlider)

The World of WarCraft tool WoWGilder is developed by MDY, and they now sue Blizzard as MDY claim it is not illegal at all.
MDY, a small Arizona software development company, recently went into litigation against Blizzard/Vivendi. In October 2006, Blizzard served a cease and desist regarding MDY’s manufacture and marketing of a bot program called WoWGlider, designed to level/mine/loot for a players WoW character without requiring player supervision. In response, MDY is calling Blizzard out, refuting that it has done anything actually illegal.
Already felt the sting of third party software
Blizzard has already felt the sting of 3rd party software in their games, as the bot leveling and item duplication once seen in Diablo II can demonstrate. In a bid to halt a repeat of that, Blizzard already has clauses in its EULA and Terms of Use for WoW, as well as having a built in program for detecting such software, Warden. They are seeking to essentially have MDY shut down and to be paid any profits MDY has already received from the sale of WoWGlider.

Despite this, MDY appears to have a pretty good case. Legally, all MDY claims to do is provide a product to a customer, and that it does not need Blizzard's permission to do so. Although WoWGliders' own FAQ specifically states that its use could result in a player’s suspension or ban, because it mimics keystrokes and mouse movements it is very hard for Warden to detect in the first place. So people use it anyway, which is a breach of their Terms of Use, but not necessarily an illegal action by MDY. Blizzard's case will rely on the strength of their claim that use of such software seriously damages their business, in terms of the amount of players banned or those that feel their gameplay experience is so damaged that they stop playing.They are also likely to mention the in-house efforts to stop the proliferation of bots and the upgrades made to Warden, before trying to directly stop WoWGliders distribution.
A sticking point is that some areas of the EULA and Terms of Use are extremely broad. As indicated by the » Slashdot article, they could even be too broad, and therefore unenforceable by Blizzard or anybody else.
The final court date is set for a year from now, as the complex electronic and copyright issues of the case requires serious preparation from both parties. However it might be one to watch, because it could set a precedent for the game industry no matter who wins. Markee Dragon, » site and opinion summed it up pretty well.: “If [MDY] does [win] it would open the flood gates of 3rd party applications for all games. Application developers would take this as an open invitation since they know that if they do it the same way as Glider did they could not be stopped.”

| As much as I don't like botters or gold farmers, I think MDY has a right to use their WoWGlider. I have never used any bots or programs for WoW and I see no point in doing so, and I played for over 2 years. But after a certain point in time when you're playing WoW, it just becomes the same old thing over and over. Wake up, go farm mats/gold, raid, farm mats/gold, repeat. From what i've researched upon, WoWGlider just does the farming of mats/gold for you, which I don't think would potentially hurt the economy at all - mainly because of the fact that 95% of the mats/gold is used for raiding. My friends who still play WoW farm about 8-10 hours per day just for certain raids. Without the need to do manual farming of mats, you can do longer raids and end-game instances will be a bit easier to complete. I'm not taking any sides, but I think WoWGlider would HELP Blizzard, actually. More players will be looking forward to actual end game instances because they don't have to farm just to get there. Also, leveling a twink will be a lot easier, too. |

| If this program will be lawfully accepted. WoW will soon turnout as Lineage II is now. People will start to farm gold for irl profit. As to sell on E-bay, or so. It's not very fun to come to a new area in the "world of warcraft" when you see a bunch of non "manned" people who just patroles a area killing stuff. Allso the in-game currency will become unbalance as the people who have used the "bot" and gained a large amount of gold. Will buy all the "expensive" and "rare" items for almost any price, since they dont care about gold. While players who play manually just can't buy them.. You quickly come to ask yourself, "What's the point for me playing manually, when other's can just level up automaticly?" The game will quickly loose its social aspect and begin to die. But I think that MDY shouldn't get away with what they are doing, because it will affect all games if people can get away with things like this. if they could come to an agreement, like this program could only be used at certain periods of time, maybe you can use it for 1 hour per day, or something like that...instead of constantly accumulating gold/shit whatevers... Maybe a special item or something lets you use it for a while... just an idea ..otherwise GO BLIZZARD! |

| wow, theres a mind steerer for you. i my mind all botting and cheating should be impossible, but you can't make it illegal to install and run a program on your computer, lets say that windows said that your not allowed to run program's that they don't find suitable, just like blizzard doesn't find guilder suitable. OMFG would there be riots on the web you can only write it in your terms and conditions that you not allowed to use it, and if you get court then BAN. |

| I side with Blizzard. WoW is blizzard's game and the players are the customers. MDY's WoW Glider a 3rd Party Program that CAN be allowed. But I give more credit to Blizzard because they think about effects. Actually I agree with #21 on the part where the bot program is used for IRL purposes. Money and could even be drugs, arms and any other dangerous stuff. Blizzard now is trying to minimize this by countering the bot. Which is good. On the other hand Blizzard can allow MDY but for a thought that this won't cause illegal deals. Illegal deals cause a lot of problems. Some people die of this, or simply get threatened and cheated at. So I guess I'll give a lot of credit to Blizzard for minimizing this. And as for gaming experience. Give your self a clap. You're being patient. Plus you even get to enjoy killing stuff. It's not boring actually. Take a look WoW in e-sports right? Work hard for your character and play it fair. Enjoy playing the game. Don't spoil it with bot programs. You'll never know maybe you'd be the one standing up being number 1. I myself am a bot user actually. In a game called Ragnarok Online here in the Philippines originally by Korea. I stopped because, I hoped that I could be an influence to other players. Non-Bot Using. So they could have fun and spend time with what they've created. That's all.. No flames please.. If you think my post is stupid.. Be surprised I'm only 14 years old. |
